Most plans allow access to your contributions in an emergency
The contributions you invest in your company's 401(k) plan are designed to help you when you need them most: at retirement. But for those unexpected circumstances that can arise, many plans allow employees to dip into their account balances before retirement. Generally, there are two ways to do this:
Loans: When you take a loan from your 401(k) account, you actually take money out of your account, with a promise to repay it. You pay your account back the balance you borrowed, plus interest (a fixed rate determined at the time of the loan), through after-tax payroll deduction. In addition, as long as you repay your loan on time, you won't be subject to withholding taxes or penalties, as you would if you withdrew from your account before retirement.
Withdrawals: Withdrawals are a different story. When you withdraw money from your 401(k) account, you can't put it back. Different plans may allow you to take withdrawals for different reasons. The most common withdrawal type for active participants is the hardship withdrawal. According to IRS regulations, to qualify for this type of withdrawal, your hardship must represent an immediate and heavy financial need and there must not be any other resources reasonably available to you to handle that financial need. The IRS recognizes four reasons for a hardship:

Anyone who has separated from service from a company with a 401(k), and is entitled to withdraw funds without penalty, may take a lump sum withdrawal of the 401(k) into a taxable account. Until 1999, the tax laws allowed people to use an income averaging method to spread that lump sum over five years for tax purposes. However, that option is no longer available; the entire withdrawal must be reported to the IRS as income in the year of the withdrawal. Alternately, an entire account can be transferred directly from the 401(k) custodian to an IRA custodian, and the account will continue to grow tax deferred.

Some 401(k) plans permit participants to borrow from the plan. The plan document must
specify if loans are permitted. A loan from the 401(k) plan is not taxable if it meets the
criteria below.
Generally, if permitted by the plan, a participant may borrow up to 50% of his or her
vested account balance up to a maximum of $50,000. The loan must be repaid within 5 years,
unless the loan is used to buy the participants main home. The loan repayments must
be made in substantially level payments, at least quarterly, over the life of the loan.
The participant must reduce the $50,000 amount, above, if he or she already had an
outstanding loan from the plan (or any other plan of the employer or related employer)
during the 1-year period ending the day before the loan. The amount of the reduction is
the participants highest outstanding loan balance during that period minus the
outstanding balance on the date of the new loan.
